2R Rent & Ride ATV Rental Agreement

WAIVER OF LIABILITY & ASSUMPTION OF RISK

All customers, including drivers and passengers, must sign a Waiver of Liability prior to participation.

The waiver must be fully completed, signed, and dated before equipment is released or any riding begins.

Renter acknowledges that ATV riding involves inherent risks, including but not limited to bodily injury, death, and property damage.

Renter voluntarily assumes all such risks known and unknown and agrees to release. waive, discharge, and hold harmless 2R Rent & Ride ATV Rental, its owners, agents, employees, and affiliates from any and all liability arising from participation.

This waiver includes, but is not limited to, claims arising from ordinary negligence.

Note: If the participant is under 18, a legal guardian must sign the minor waiver addendum in accordance with Texas law.

RENTAL TERMS & ELIGIBILITY

Renter must be at least 21 years of age with a valid government-issued photo ID.

All operators must be listed on the waiver and comply with safety rules and ATV operating instructions.

No safety equipment is provided by 2R Rent & Ride ATV Rental. Renter assumes full responsibility for their own protective gear and safety precautions.

PAYMENT, DEPOSITS & CANCELLATION POLICY

A 50% non-refundable deposit is due at the time of booking.

The remaining balance is due no later than 2 calendar days before the rental date.

Cancellations made with more than 48 hours' notice may be eligible for in-house rental credit only, valid for 6 months.

Cancellations with less than 48 hours' notice or no-shows are non-refundable and not eligible for credit.

No refunds will be issued for equipment malfunctions; rental fees remain non-refundable. Only in-house rental credit for next rental.

EQUIPMENT RESPONSIBILITY & DAMAGE POLICY

Renter is fully responsible for the ATV(s) and all rented equipment from the time of delivery or pick up until returned.

Any damage, theft, or loss will be charged to the Renter's credit card on file.

Equipment must be returned clean and undamaged. A cleaning fee may apply if returned excessively dirty.

Late returns are subject to additional hourly or daily rental fees.

INSURANCE & LIABILITY

2R Rent & Ride ATV Rental does not provide liability or collision insurance for renters

Renter agrees to assume full financial responsibility for any injuries or damages to persons or property.

Renter is encouraged to obtain personal insurance coverage for ATV rental activities.

INDEMNIFICATION

Renter agrees to indemnify, defend, and hold harmless 2R Rent & Ride ATV Rental, its owners, agents, and employees from and against any and all claims, demands, losses, liabilities, damages, expenses (including attorney's fees), or causes of action arising out of or in connection with the use or misuse of the rented ATV and equipment.

GOVERNING LAW & DISPUTE RESOLUTION

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas.

Any legal action or proceeding arising from this Agreement shall be brought exclusively in the courts located in Anderson County, Texas.

If any provision of this Agreement is held to be unenforceable, the remaining provisions shall remain in full force and effect.

ENTIRE AGREEMENT

This document constitutes the entire agreement between the parties and supersedes all prior discussions or agreements, whether oral or written. No modification shall be valid unless in writing and signed by both parties.
